1. Introduction

Welcome to Indobazaar. By accessing or using the Indobazaar platform (the "Platform"), you agree to be fully bound by these Terms of Service and our Privacy Policy (collectively, the "Agreement"). Please read this Agreement carefully before using the Platform.

Indobazaar is an online marketplace platform that acts solely as a neutral intermediary ("middleman") connecting sellers, service providers, and product owners ("Sellers") with potential customers and buyers ("Buyers"). Indobazaar does not sell, resell, endorse, or guarantee any product, service, or listing published on the Platform.

By registering, accessing, browsing, or transacting on the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

2. Platform Role and Nature of Service

2.1 Middleman / Intermediary Role

Indobazaar serves exclusively as a communication bridge between Sellers and Buyers. Our role is limited to:

• Providing a platform where Sellers can list and showcase their services, products, and contact details.
• Enabling Buyers to browse, discover, and contact Sellers based on their needs.
• Facilitating the sharing of contact information between verified parties.
• Indobazaar is NOT a party to any transaction, agreement, or arrangement made between a Seller and a Buyer. Any contract, transaction, purchase, service delivery, or dispute arising from such interactions is strictly between the Seller and the Buyer.

2.2 No Endorsement

The presence of any listing, product, or service on Indobazaar does not constitute an endorsement, recommendation, guarantee, or warranty by Indobazaar. Buyers are solely responsible for conducting their own due diligence before engaging with any Seller.

3. Eligibility and Registration

• You must be at least 18 years of age to register and use the Platform.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• Indobazaar reserves the right to suspend or terminate any account that provides false or misleading information.

4. Seller Obligations and Responsibilities

4.1 Listing Submission

All Sellers wishing to list their services or products on Indobazaar must:

• Submit accurate, truthful, and complete information about their offerings.
• Ensure all listings comply with applicable Malaysian laws and regulations.
• Provide valid and reachable contact information.
• Upload only original or properly licensed content including photos, videos, documents, PDFs, links, and other media.

4.2 Content Review and Verification

All listings submitted by Sellers will undergo a review process by the Indobazaar team within 24 hours of submission. During this period:

• Our team will assess the listing for compliance with platform guidelines.
• If modifications are required, Indobazaar will notify the Seller with clear guidance on what needs to be amended.
• Listings that fail to meet platform standards may be rejected, suspended, or removed without prior notice.

4.3 Prohibited Content

Sellers are strictly prohibited from uploading or sharing the following on Indobazaar:

• Offensive, abusive, hateful, discriminatory, or obscene language or content.
• Copyrighted images, videos, audio, songs, PDFs, or any media that the Seller does not own or have explicit legal right to use.
• Unauthorized or malicious third-party links, redirects, or embedded content.
• Spam, misleading information, fraudulent claims, or deceptive pricing.
• Content that violates any applicable law or regulation.
• Links or content promoting illegal activities, violence, gambling, adult content, or prohibited substances.

4.4 Intellectual Property Responsibility

Sellers bear sole and full responsibility for all content they upload to the Platform, including but not limited to images, videos, audio files, PDFs, hyperlinks, logos, text, and any other media. By uploading content, Sellers confirm and warrant that:

• They are the rightful owner or hold proper legal authorization to use and publish the content.
• The content does not infringe upon the intellectual property rights of any third party.
• Indobazaar is fully indemnified from any claim, liability, cost, or damage arising from copyright infringement or unauthorized use of content uploaded by Sellers.

5. Buyer Responsibilities

Buyers using the Indobazaar Platform acknowledge and agree to the following:

• All purchasing decisions, verification of products or services, and due diligence are the sole responsibility of the Buyer.
• Indobazaar does not verify the quality, safety, legality, or authenticity of any product or service listed on the Platform.
• Buyers must independently verify the credibility and legitimacy of a Seller before completing any transaction.
• Indobazaar is not responsible for any loss, damage, dispute, fraud, or dissatisfaction arising from a transaction between a Buyer and a Seller.
• Buyers are encouraged to exercise caution and conduct proper verification before making any payment or commitment.

6. Platform Rights and Moderation

Indobazaar reserves full and unconditional rights to:

• Remove, suspend, or permanently delete any listing, account, or content that violates these Terms of Service, without prior notice.
• Refuse, restrict, or revoke access to the Platform for any Seller or Buyer at its sole discretion.
• Modify, update, or discontinue any feature, category, or service on the Platform at any time.
• Take legal or administrative action against Sellers who upload unauthorized, fraudulent, or harmful content.

These rights are exercised to maintain the integrity, safety, and quality of the Indobazaar marketplace.

7. Unauthorized Links and Third-Party Content

The use of unauthorized, spam, or malicious third-party links on the Indobazaar Platform is strictly prohibited. Any Seller found in violation of this policy will be subject to immediate account suspension, listing removal, and potential legal action.

Indobazaar accepts no responsibility or liability for the content, accuracy, safety, or availability of any third-party websites or services that may be referenced or linked by Sellers on the Platform. Accessing third-party links is done entirely at the Buyer's own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Indobazaar, its officers, directors, employees, partners, and affiliates shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Platform.
• Any loss of profit, revenue, data, business, or goodwill resulting from transactions or interactions facilitated through the Platform.
• Any fraudulent activity, misrepresentation, or breach of contract by any Seller or Buyer.
• Any failure, error, interruption, or downtime of the Platform, whether caused by technical issues, maintenance, or third-party failures.
• Any disputes, claims, or legal proceedings arising between Sellers and Buyers.

Indobazaar's role is limited to providing the Platform infrastructure. All liability for transactions and content rests solely with the Sellers and Buyers involved.

9. Prohibited Conduct

The following actions are strictly prohibited on Indobazaar for all users (Sellers and Buyers):

• Using offensive, vulgar, or abusive language in any listing, message, or communication.
• Engaging in fraud, impersonation, or misrepresentation.
• Attempting to bypass, manipulate, or exploit any feature of the Platform.
• Harvesting, scraping, or collecting user data without authorization.
• Uploading malware, viruses, or any harmful code.
• Engaging in any activity that disrupts or interferes with the Platform's normal operations.

11. Modifications to Terms of Service

Indobazaar reserves the right to update, modify, or revise these Terms of Service and Privacy Policy at any time. Users will be notified of significant changes through the Platform or via email. Continued use of the Platform following the posting of changes constitutes acceptance of the revised Agreement.

It is the responsibility of all users to review these Terms of Service periodically.

12. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or related to the use of the Indobazaar Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
